Agreed ... btw these are two completly different questions ... i wanted to know if it was legal to transport birds?

and is it legal to see a unweaned bird to a responcible person or is it legal to remove a breeded bird from its nest for hand raising.

In America its against the law for breeders to hand raise birds that are hatched by hens ... in other words on incubator birds can be hand raised this is what i was trying to understand.

It is illegal to sell unweaned birds yet the classifieds are full of ads for them .

I do stress i wanted to know two different questions. I have no intentions of selling unweaned birds for transportation.

I was more wanting to know is it illegal to transport a bird in a box? WEANED.

Is it illegal to remove a bird from a nest to hand raise?

Is it illegal to sell a unweaned bird? Incubator or otherwise?

Yes in NSW .

No but there are guidelines to box size etc.

Is it illegal to remove a bird from a nest to hand raise?

From a wild nest yes from your own domestic nests No.

However sadly these rules are rarely governed so people do what they want anyway ....

Are you kidding me ?

Of course it should be an issue , it takes one little upset to make a birds crop slow down which can lead to suffering and death .
They stress easily and stress leads to problems . How could anyone justify selling an unweaned bird ?
If another breeder wants the bird so bad they should wait until it is fully weaned and ready to go .

In Victoria it is actually illegal to trade in unweaned birds, I had this arguement recently on another site, it seems there is some federal law that says you can not trade in unweaned birds, but in Qld it is legal to move a bird for hand rearing , not legal in Vic and I'm not sure of the other states, personally I wouldn't do it, if you can't handrear yourself then don't pull the bird from the nest. And if you can't reed for yourself then why hand rear....I see it as a money making thing on both sides, the breeders pulling birds so their parents go down again and the hand rearers doing it as a money making venture not so much for the love of the birds....NOT really crazy about how prevalent the practice has become.

The relevant section from the victorian site
Hand-Rearing Birds
The hand-rearing of birds held under a private wildlife
may generally only be undertaken by the holder of that
licence. Under the Wildlife Regulations 2002, it is illegal
to buy, sell, dispose of, consign, convey or transport any
egg or any bird that is too young to fly (or, if a flightless
bird, is less than four weeks old), for any purpose other
than treatment by a registered veterinary surgeon,
(whether or not a licence is required), unless the prior
written permission of the Secretary has been
received. Contact the Wildlife & Game Licensing Servic
