Blu Jay you put it so much better than me, when I posted RESPONSABILITY. When I contacted the seller in my case about selling me 7 cock birds
out of four pair of Diamonds. He text back, you should know what CAVEAT EMPTOR means, I text to him, It means YOU are a THIEF.
They are out there.

@Spitfire, oh goody, your seller knows Latin. Then the seller should know the meaning of;
Uniuscujusque contractus initium spectandum est, et causa. Meaning THE COMMENCEMENT and CAUSE OF EVERY CONTRACT ARE TO BE CONSIDERED!!!
In my estimation, what this seller did to you is THEFT BY DECEPTION. The seller purposely obtained your money by deception, to UNJUSTLY ENRICH, themselves.
I believe their message to you, proves this fact. If I were you, I would forward their message to the appropriate administrative agency along with your questions concerning it.
Until people stand up to this caliber of conduct will we ever have any weapon to put an end to it.
This caliber of conduct is a black eye to aviculture, and approaches criminal misconduct. Total honesty and ultimate fairness are essential in business, and without both we have lost much of what hard working Australians have fought for over the years. I am sorry this have happen to you. Regards.

It all boils down to,if anyone is gullible enough to send birds to a buyer before they have the money in the bank then the seller beware.SO make sure their money is in your pocket no matter what the buyer says as there is some slick operators out there.
If they want it all their way,hang up in their ear they will get the message. Craig

Could that not go the other way though? Like, if you send the money then they don't send the birds? Thats what i've always been a bit dubious about in regards to freighting (never bought birds that needed to be freighted before)
I may be wrong, having never done it before.

Well i have never had that problem but it could happen i suppose,it would be interesting if it has happened to someone on here and what did they do.When you have money involved and have documents to prove it,it becomes a small claim case against the seller.It's different senario when they buyer doesn't send the money for the birds as there are no monetary documents that he even received birds from you and if you can't prove that birds are yours to begin with you haven't got a leg to stand on. Hi Craig, I'm somewhat taken back with your comment, wherein you state if there is no moneatary trail, they couldn't prove the birds were theirs and they wouldn't have a leg to stand on!
Wouldn't the seller, have paperwork to fill out to to ship the birds? Also wouldn't the receiver have to show ID prior to the birds being released to receiver?
If person, birds were shipped to, claim not to have had received the birds. The appropriate cause of action would be, complain to the courier for losing the birds, as well as, the appropriate administrative agencies as against the courier for losing the birds. It would be my opinion, no courier likes to have complaints of lost shipments, and would begin an investigation.
This is what I would do in a situation like this. Besides you would stand more chance of getting reimbursed by the courier for losing the birds. They simply have more money. Regards.

That makes sense, you would have all the banking statements and whatnot.
